Zambia is a developing nation within the continent of Africa. The country does not boast many businesses or a good economy. As a result, very few businesses try to establish their market here. Those who do, face several administrative and legal roadblocks due to inefficiency of the system. As a result of these similar issues, Dr. Rajan Mahtani has not been able to receive justice. For the past decade, he has been fighting for the legal takeover of the Zambezi Portland Cement factory. The case was first registered at the Lusaka High Court where it stretched for a decade. Despite sharing enough evidences, the final judgement from the Lusaka High Court went against Dr. Mahtani’s claims. The judge at the Lusaka High Court was Justice Nkonde who said that Ventriglias were only shareholders of the Zambezi Portland. This prompted Dr. Mahtani to approach further to Court of Appeal.
The Court of Appeal announced its judgement on 31st January 2019. This judgment was based on evidences, testimonials and was totally transparent and ethical. The judge at the Court of Appeal was Justice Mwinde who gave the final decision during the morning hours of 31st. According to this decision, Finsbury Investments holds 58 percent shares and is the majority shareholder of the Zambezi Portland Cement. On the other hand, Ventriglias own 42 percent shares at the factory and are the minority shareholders. As per this decision, Dr. Rajan Mahtani owned Finsbury Investments is the legal owner of the factory with majority shareholding. The judge further confirmed that this decision is aligned with the original Shareholding Agreement established in the year 2007.
